Article 3 - Applicability

These General Terms and Conditions apply to every offer made by De Egaline Schuur and to every distance contract concluded between De Egaline Schuur and the consumer.

Before a distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. Where this is not reasonably possible, De Egaline Schuur will explain how the General Terms and Conditions may be consulted and will provide them to the consumer free of charge as soon as possible upon request.

Where a distance contract is concluded electronically, these General Terms and Conditions may be made available to the consumer electronically in a manner that allows the consumer to store them easily on a durable medium.

Any deviation from these General Terms and Conditions must be agreed in writing. If one or more provisions of these General Terms and Conditions are at any time wholly or partially void or annulled, the remaining provisions of the contract and these General Terms and Conditions will remain in full force and effect.

Article 4 - The Offer

If an offer is valid for a limited period or is subject to conditions, this will be stated explicitly in the offer.

The offer contains a complete and accurate description of the products offered, such as self-levelling compounds and related accessories. The description is sufficiently detailed to enable the consumer to assess the offer properly. Obvious mistakes or errors in the offer are not binding on De Egaline Schuur.

All images, specifications and information included in the offer are indicative and do not entitle the consumer to compensation or to terminate the contract.

Each offer contains sufficient information to make clear to the consumer the rights and obligations arising from acceptance of the offer.

Article 5 - The Contract

The contract is concluded when the consumer accepts the offer and fulfils the conditions stated in the offer.

If the consumer accepts the offer electronically, De Egaline Schuur will promptly confirm receipt of that acceptance electronically.

De Egaline Schuur will provide the consumer, together with the product or service, with the following information in writing or in another form that allows it to be stored accessibly on a durable medium:

  • the physical address of the De Egaline Schuur business location where the consumer may submit complaints;
  • the conditions and procedure for exercising the right of withdrawal, or a clear statement where the right of withdrawal is excluded;
  • information on warranties and available after-sales service;
  • the information set out in Article 2 of these General Terms and Conditions, unless De Egaline Schuur has already provided that information before performance of the contract; and
  • the requirements for terminating the contract where the contract has a duration of more than one year or is concluded for an indefinite period.

Article 6 - Right of Withdrawal

The consumer may withdraw from a contract for the purchase of a product without giving any reason during a cooling-off period of 14 days.

The cooling-off period referred to in paragraph 1 begins on the day after the consumer, or a third party designated in advance by the consumer, receives the product.

Products made to the consumer's specifications, or products that by their nature cannot be returned, are excluded from the right of withdrawal (see Article 10).

Article 7 - Consumer Obligations During the Cooling-Off Period

During the cooling-off period, the consumer must handle the product and its packaging with due care. The consumer may unpack or use the product only to the extent necessary to establish its nature, characteristics and functioning.

The consumer is liable only for any reduction in the value of the product resulting from handling that goes beyond what is permitted under paragraph 1.

The consumer is not liable for any reduction in value if De Egaline Schuur did not provide all legally required information concerning the right of withdrawal before or at the time the contract was concluded.

Article 8 - Exercise of the Right of Withdrawal and Associated Costs

To exercise the right of withdrawal, the consumer must notify De Egaline Schuur within the cooling-off period by using the model withdrawal form, which may be requested at info@egalineschuur.nl, or by making another clear and unambiguous statement.

The consumer must return the product, or hand it over to De Egaline Schuur or its authorised representative, as soon as possible and no later than 14 days after the day on which the withdrawal notice was submitted.

The consumer must return the product with all supplied accessories and, where reasonably possible, in its original condition and packaging, in accordance with the reasonable and clear instructions provided by De Egaline Schuur.

The consumer bears the direct cost of returning the product. For the exact conditions, available return options, including a collection service, and any charges relating to the return of an entire order, please refer to the De Egaline Schuur Returns Policy.

If the consumer exercises the right of withdrawal, all supplementary contracts will be terminated automatically.

Article 9 - Trader Obligations in the Event of Withdrawal

If De Egaline Schuur allows the consumer to submit a withdrawal notice electronically, it will promptly send an acknowledgement of receipt after receiving the notice.

De Egaline Schuur will reimburse all payments received from the consumer, including any delivery charges imposed by De Egaline Schuur for the returned product, without undue delay and no later than 14 days after the day on which the consumer notifies De Egaline Schuur of the withdrawal.

De Egaline Schuur may withhold reimbursement until it has received the product or until the consumer provides evidence that the product has been returned, whichever occurs first.

De Egaline Schuur will use the same payment method used by the consumer for the original transaction, unless the consumer agrees to another method.

Article 10 - Exclusion of the Right of Withdrawal

De Egaline Schuur may exclude the consumer's right of withdrawal where permitted under this Article, including in the following cases:

  • Moisture- and temperature-sensitive construction materials. Products such as self-levelling compounds, mortar and other construction materials that are sensitive to moisture, temperature or storage conditions may be excluded from the right of withdrawal under Article 6:230p(d) and (f) of the Dutch Civil Code. This applies where the packaging has been opened or damaged after delivery, the product has not been stored in accordance with the applicable instructions, or the quality or shelf life of the product can no longer be guaranteed as a result. A product may still be returned within the cooling-off period if its packaging remains unopened and undamaged and the product has been stored correctly. Please refer to the De Egaline Schuur Returns Policy for the complete conditions.
  • Products made to the consumer's specifications. This includes products that are not prefabricated and are produced on the basis of the consumer's individual choice or decision, or products that are clearly intended for a specific person, such as a self-levelling compound specially mixed or measured to order.
  • Sealed products. Products that are unsuitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.
  • Products irreversibly mixed with other products. Products that, by their nature, become inseparably mixed with other products after delivery.

Where applicable, the exclusion of the right of withdrawal for a specific product will be stated clearly in the offer and on the relevant product page.

Article 11 - Prices

During the validity period stated in the offer, the prices of the products offered will not be increased, except where a price change results from a change in the applicable VAT rate.

All prices are subject to printing and typographical errors. De Egaline Schuur accepts no liability for the consequences of such errors.

All prices displayed on the website include VAT.

Shipping charges: orders below EUR 150 are subject to a shipping charge of EUR 29.95. Shipping is free for orders of EUR 150 or more. The applicable shipping charges will be displayed clearly during checkout before the contract is concluded.

Article 12 - Conformity and Warranty

De Egaline Schuur warrants that the products conform to the contract, the specifications stated in the offer, reasonable requirements of quality and usability, and the statutory provisions and government regulations in force on the date the contract is concluded.

Any warranty provided by De Egaline Schuur, the manufacturer or the importer is in addition to, and does not affect, the consumer's statutory rights and remedies against De Egaline Schuur under the law and/or the contract.

Any defects or incorrectly delivered products must be reported to De Egaline Schuur in writing or by email within a reasonable period after they are discovered.

Article 13 - Delivery and Performance

De Egaline Schuur will exercise the greatest possible care when receiving and fulfilling product orders.

Delivery will be made to the address provided by the consumer to De Egaline Schuur.

Fulfilment through Intr. De Egaline Schuur uses the services of Intr to fulfil and ship orders. Once an order is placed, it is forwarded directly to Intr, which processes, packs and ships the order on behalf of De Egaline Schuur.

Regardless of Intr's involvement in fulfilment, De Egaline Schuur remains fully responsible for performing the contract and is the consumer's sole point of contact for all questions, complaints, returns and warranty matters relating to the order. The consumer should therefore not contact Intr directly.

De Egaline Schuur will fulfil accepted orders as soon as reasonably possible and no later than 30 days after acceptance, unless another delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can be fulfilled only in part, the consumer will be informed as soon as possible.

The risk of damage to and/or loss of products remains with De Egaline Schuur until the products have been delivered to the consumer, unless expressly agreed otherwise.

Article 14 - Payment

Payments may be made using the payment methods offered on the website and are processed through Shopify Payments.

The consumer must promptly notify De Egaline Schuur of any inaccuracies in the payment information provided or displayed.

If payment is not made on time, De Egaline Schuur may, after notifying the consumer, terminate the contract with immediate effect or suspend fulfilment of the order.

Article 15 - Complaints Procedure and Disputes

Complaints concerning performance of the contract must be submitted to De Egaline Schuur at info@egalineschuur.nl within a reasonable period after the consumer discovers the issue. Complaints must be complete and clearly described.

Complaints submitted to De Egaline Schuur will be answered within 14 days of receipt. If a complaint requires a longer processing period, De Egaline Schuur will acknowledge receipt within that 14-day period and indicate when the consumer may expect a more detailed response.

WebwinkelKeur and the Disputes Committee. De Egaline Schuur is affiliated with the WebwinkelKeur trustmark. Complaints that cannot be resolved by mutual agreement must be submitted to WebwinkelKeur, which will provide mediation free of charge. If no solution is reached through mediation, the consumer may refer the dispute to the independent disputes committee appointed by WebwinkelKeur. The committee's decision is binding, and both De Egaline Schuur and the consumer agree to be bound by that decision. The consumer is responsible for any fees charged by the relevant committee for handling the dispute.

Contracts between De Egaline Schuur and the consumer that are governed by these General Terms and Conditions are subject exclusively to Dutch law.

Article 16 - Force Majeure

De Egaline Schuur is not required to perform any obligation towards the consumer where performance is prevented by circumstances that are not attributable to De Egaline Schuur and for which De Egaline Schuur is not responsible under the law, a legal act or generally accepted standards.

Force majeure includes, but is not limited to, disruptions or failures affecting suppliers, including Intr, transport problems, strikes, fire, government measures, and failures of telecommunications networks or connections.

Article 17 - Intellectual Property

All intellectual property rights relating to the website, logos, product and company names, and other content of De Egaline Schuur are owned by De Egaline Schuur or its licensors. Such materials may not be used, reproduced or made public without prior written permission.

Article 18 - Liability

De Egaline Schuur is liable for loss or damage suffered by the consumer only to the extent that such loss or damage is caused by intentional misconduct or deliberate recklessness on the part of De Egaline Schuur.

De Egaline Schuur is not liable for loss or damage resulting from incorrect or improper use of the supplied products, such as self-levelling compounds and related accessories, or from failure to follow the instructions for use or application guidance supplied with the product.

De Egaline Schuur's total liability is in all cases limited to the amount paid by the consumer for the relevant order, unless mandatory law provides otherwise.

Article 19 - Additional or Deviating Provisions

Additional provisions or provisions that deviate from these General Terms and Conditions may not be detrimental to the consumer and must be recorded in writing or in another form that allows the consumer to store them accessibly on a durable medium.

Article 20 - Amendments to the General Terms and Conditions

De Egaline Schuur may amend these General Terms and Conditions from time to time.

Minor amendments may be made at any time. The version in force when the contract with the consumer was concluded will always apply, unless mandatory law provides otherwise.
